Confidentiality and Ethical Practice: Navigating 42CFR Part 2, HIPAA and Professional Responsibility

Sponsor: NH Alcohol and Drug Abuse Counselors Association

Changes in confidentiality regulations and a changing healthcare landscape demanding increased integration of behavioral and physical healthcare make it critical for substance use disorder and mental health practitioners to have a firm grasp of the rules and laws that govern their practice in order to ensure the confidentiality and privacy of the clients they serve. Managed care, duty to warn issues, mandated reporting, the growing number of mandated clients, the increase in integrated healthcare delivery networks and the litigious nature of our society add additional stress to this requirement. This workshop will review the relationship between HIPAA and 42 C.F.R. Part 2, including the recent changes in the Federal Confidentiality Regulations governing Substance Use Disorder Patient Records (42 C.F.R. Part 2). The practical application of these regulations will be examined with respect to integrated care networks, client safety issues, duty to warn, working with mandated clients, and dealing with subpoenas and court orders.
